LUMI Chatbot — Terms of Use

Before you use the LUMEUS AI Coach, we ask you to consent to the following data processing:

Your inputs (e.g. questions, descriptions of how you are feeling) are transmitted to an AI language model service from Anthropic PBC, San Francisco, USA, to be answered. The transmission to the USA is based on the EU Standard Contractual Clauses (Art. 46(2)(c) GDPR) which we have agreed with Anthropic. Anthropic stores your requests for up to 30 days and then deletes them. The transmission is encrypted and exclusively for processing your request. Anthropic does not process your data for its own training purposes (in accordance with API Terms of Service).

Voice function (optional): If you use the voice function, your voice recording for conversion to text and the AI Coach's response for conversion to speech are transmitted encrypted to Google Cloud (Google Ireland Limited, Dublin, Ireland; parent company: Google LLC, USA). A transmission to the USA is based on the EU Standard Contractual Clauses, which are part of the Data Processing Addendum concluded with Google. Google does not store your audio data and texts permanently and does not use them for its own training purposes (in accordance with Google Cloud Terms of Service and Data Processing Addendum). We also do not store your audio recordings — only the text generated from it is stored encrypted as part of your conversation history, as described below. The voice function is voluntary; you can use the AI Coach at any time with text input only.

Since you can enter topics such as mood, stress, sleep or eating behavior, your information may contain health data in the sense of Art. 9 GDPR. This processing is based on your explicit consent (Art. 9(2)(a) GDPR).

Please only share what is necessary for your request and do not enter data about other people. Avoid unnecessary information that directly identifies you or third parties (e.g. full names, addresses).

Your inputs are processed and stored for the duration of your active account so that your conversation history is available to you. Your data will be deleted as soon as your account is deleted — by you or by us. If you want to delete the data you have entered in the AI Coach even before that, while your account remains, you can do so at any time: in the app under Settings → LUMI AI Chatbot or on lumeus-app.de in your profile under "Consents & Data Protection". Note: The LUMEUS AI Coach provides general information and motivation on topics such as nutrition, stress management, sleep and emotional well-being. It does not replace medical or psychotherapeutic advice, diagnosis or treatment. For serious health concerns or mental health crises, please consult a doctor or mental health professional.

Topics such as depressive symptoms, anxiety disorders, sleep disorders or eating disorders can be serious illnesses. Please seek professional help immediately if symptoms persist or are severe. In acute crises, contact the medical on-call service (116 117) or the Telefonseelsorge crisis line (0800 111 0 111, free of charge, 24/7).

EmoTrain GmbH assumes no liability for decisions made on the basis of AI outputs.

You can withdraw your consent at any time with effect for the future — with one click in the app under Settings → LUMI AI Chatbot or on lumeus-app.de in your profile under "Consents & Data Protection"; alternatively by email to [email protected]. Upon withdrawal, your previous conversation data will be deleted. You also have the right to information, correction, deletion and the right to lodge a complaint with a data protection supervisory authority. ✔️ I explicitly consent to the transmission of my inputs to Anthropic PBC (USA), and if I use the voice function, additionally to Google Cloud (Ireland/USA), as well as the processing of health data as described above. This consent is voluntary; without it you cannot use the AI Coach, but the other functions of the app remain available to you.
